Mesothelioma law firm (firms)
There are many Mesothelioma Law Firms and Mesothelioma Lawyers around the nation, however, it is important that you meet your individual lawyer and select one that has the same goals in mind as your family. Some lawyers are trial lawyers and will focus on bring the case to trial in hopes of bringing out the full value of your case. This approach can land a multi million dollar verdict but may also leave you with nothing in your pocket. Remember that a jury is always unpredictable, regardless of the strength of your case. Other lawyers are more apt to be good negotiators and will get you a fair settlement without going to trial. Often times you will get your money much faster but in some of the cases you will have to settle for less money to receive it now.
Mesothelioma Law Firms or Mesothelioma Lawyers should specialize in only handling cases which involve the negligent use of asbestosis. Thousands of companies are responsible for maintaining unhealthy work environments or producing products which contained asbestos. The Mesothelioma Law Firm that your hire should be very experienced with all of the companies that manufactured or handled asbestosis within the last 30 years. This is a long list of companies and therefore your lawyer should have a long career in handling these types of claims and dealing with the obvious defendants.
There are numerous mesothelioma law firms to take advantage of.
We present a few big and respectable mesothelioma law firms.
Early, Ludwick, Sweeney & Strauss
It is very easy to lose your rights completely. Each state has its own set of deadlines, called statutes of limitation, for allowing victims of asbestos disease to file lawsuits. This means that there are strict deadlines for filing claims or lawsuits after becoming aware that you have an asbestos disease or after a loved one dies from an asbestos disease.
Early, Ludwick, Sweeney & Strauss has offices in New York and Connecticut, but I live in California or Florida. Why should I hire Early, Ludwick, Sweeney & Strauss instead of a local lawyer?
First, Early, Ludwick, Sweeney & Strauss is a law office that has specialized in this area of the law for twenty years. Thus, we have the expertise to handle this exact type of case. Second, just because you live in a different part of the country, does not mean that you should file a lawsuit or hire a lawyer in that part of the country. The reasons for this are twofold:
a.) Some jurisdictions (such as New York City) are more receptive to asbestos diseases claims in that the claims are worth more money than in other jurisdictions.
b.) You may have been exposed to Asbestos in more than one state.
Therefore you have a choice as to where your lawsuit can be filed. Early, Ludwick, Sweeney & Strauss is an expert at determining where your case should be filed so that your case is worth the most amount of money. When cases are filed in other states, we associate with "local" attorneys from that state, as we have developed an extensive network of the very best attorneys throughout the country. Thus, you will have two of the very best law firms handling your case for the same fee, and at no more of an expense to you.
If I do file a lawsuit, how long will it be before I see any money?
The answer to this question depends on the severity of your disease. If you have a malignant diagnosis and are still living, you will likely receive some money within 4 months, and your case will be completely finished from 6 to 12 months. Thus, the entire process, from start to finish, usually lasts no more than 1 year.
I'm afraid of going to trial. Will I have to go to trial if I don't want to?
Most of our cases settle, and so it isn't likely that you will have to go to trial unless you demand it. If you do have to go to trial, and you are subject to cross examination in a deposition or in court, rules have been established to avoid embarassment and to make the process as uninvasive as possible. Is it much work for me if I decide to file a lawsuit and bring a case against asbestos companies?
The hardest thing to do is to make the initial decision to file a lawsuit. After that, we attempt to make the process as easy as possible. How much will it cost me to bring a lawsuit?
It will cost you nothing. Since Early, Ludwick, Sweeney & Strauss works on a contingent fee basis, a lawsuit costs nothing to a client unless money is recovered on behalf of the client. Therefore, you are not taking any risks in filing a lawsuit.
What about expenses? Will I be responsible for huge expenses even if I don't receive any money?
No. Expenses are part of the costs to bring a lawsuit. If you don't receive any money, you are not responsible for the costs to bring that lawsuit.
What if I do receive money. Won't expenses take away a big part of the money to which I am entitled?
No. Expenses can be a big part of a lawsuit, but because Early, Ludwick, Sweeney & Strauss has been working in this area for so many years, our expenses in bringing lawsuits are very low. If you receive settlement money prior to trial, expenses tend to run only between 3% to 5% of the moneys received. (Therefore, you will likely receive 95% to 97% of the money to which you are entitled.)
Is it possible that my case may "get lost" in group or class action settlement?
No. From time to time, asbestos producers and their lawyers approach us to discuss settling a group of cases. These settlements categorize cases by disease, and cases within each disease are subject of a range of settlement values. This strategy allows strong cases not to be affected by weak cases and vice versa. Furthermore, exceptional cases receive exceptional treatment, and those exceptional cases qualify for an even higher settlement. But, before any settlement becomes operative, that settlement must first be approved by you as the client.
What if I don't want to settle because I think that value is too low or that I want my day in court?
Then, you don't have to agree to the settlement. No client can be bound by a settlement without his/her consent. Each client has the right to accept or reject any settlement offer and have his/her day in court.
